1. Acceptance of Terms

By accessing and using the Fingal Memorials Design Studio website (the "Service"), you agree to be bound by these Terms of Service (ToS). If you disagree with any part of the terms, then you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Intellectual Property Rights (IP)

The Service, the original content, features, and functionality, including the design application's underlying code, graphic assets, and digital textures, are and will remain the exclusive property of Fingal Memorials and its licensors.

• **Code and Design:** Reproduction, reverse engineering, unauthorized modification, or distribution of this software's code or visual design is strictly prohibited.
• **Generated Images/Quotes:** Images generated by the user through the Design Studio are the property of Fingal Memorials until a full purchase agreement is finalized. These images are for illustrative, quote-request purposes only and contain proprietary watermarks.
• **Usage License:** Upon final purchase and payment for a memorial, you are granted a non-exclusive license to use the final design as represented in the completed memorial product.

3. Accuracy of Service & Pricing

• **Visual Representation:** While we strive for accuracy, the colors, textures, fonts, and sizes displayed in the Design Studio are for visual estimation only. The final product and materials may vary slightly due to natural stone variations, lighting, and manufacturing processes.
• **Quote Validity:** Submitting a design generates a free quote based on your specifications. This quote is **non-binding** and may be adjusted upon final confirmation of material availability, site details, engraving specifics, and installation costs.
• **Information Accuracy:** You are responsible for ensuring the accuracy of all text (names, dates, verses) provided in the Design Studio. Fingal Memorials is not liable for errors in the final product resulting from incorrect information provided by the customer.

4. Limitation of Liability

In no event shall Fingal Memorials, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any and all personal information stored therein.

5. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction, e.g., Ireland], without regard to its conflict of law provisions.
